SALES

 

By purchasing a electric scooter you acknowledge Electrek’s terms and conditions.

 

GUARANTEE AND WARRANTY

 

Once you have purchased your electric scooter, we offer a 24 hour satisfaction guarantee.

If you are not happy with your scooter you are welcome to bring it back for a full refund within 24 hours.

 

We offer a 3 month warranty on the battery, the controller/mother board.  

 

Warranties will not be honored if products have been misused.  Please operate you scooter in a manner that is in keeping with the capabilities for which it was designed.

 

None of our scooters are manufactured for off-road.  This will be regarded as misuse, although we can fix, they will not be covered by our warranty.

 

RETURNS

 

There are a few terms and conditions for a full credit see below:

Returned products must be received in 100% new, saleable condition. Products are not eligible for refund if they have been worn, used in any way. Merchandise must arrive complete, in the original box (including warranty cards, manuals, accessories, promotional items, etc.)

 

CARE AND MAINTENANCE

 

From time to time maintenance is needed to be performed by the owner. This includes checking for loose connections, loose bolts and nuts, setting the brakes, etc. This are some (but not all) of the maintenance required to be done by the owner to get long and enjoyable use from their scooter.

Charge your batteries after each ride and NEVER let the batteries run completely flat - Do not push-ride the scooter if the battery power is diminishing, as this will cause an overload in the controller, which is not covered by warranty.

As the batteries lifespan is dependent on the user and charging intervals, Batteries are only covered for 90 days .

Defects resulting from misuse, abuse or negligence will void any warranty.

 

Always wear safety gear (Helmets) when riding any of our scooters.

Never leave any of the products charging overnight. They should always be in plain site when charging and do not charge while unattended.

 

EVENTS 

Cancellations and changes in bookings


100% of the paid amount is non-refundable if  The Client cancelled 24 hours or less prior to the function date. 

The Client will receive a full refund if Cape Town Electrek cancels the event.

Cape Town Electrek shall be entitled to 100% of the booked amount.
No refunds will be given to the client for items hired and not used during the event.

 The client furthermore agrees to be responsible for all legal costs on attorney client scale, including collection commission, in respect of any proceedings instituted by Cape Town Electrek for the recovery of any goods or amounts owning by the client in terms of the agreement for any damages.


Accidents/Injuries/Death and other Liabilities

In the event of any kind of loss, damage, injuries, or death before, during and after any event, Cape Town Electrek will not be held responsible or liable for any kind of claims of whatsoever nature.  
The client takes full responsibility for damages/ losses of any kind.


RIGHT OF ADMISSION RESERVED

In the event of any kind of accident Cape Town Electrek will not be held responsible/liable for any kind of injuries to persons/ third parties and its employees, any kind of disability or death resulting on any kind of accident before and or/ during and or/ after the event. The client takes full responsibility for injuries and or deaths that may occur.
These terms and conditions are compulsory and binding upon payment, even if the client has not signed the terms and conditions.

 

RENTALS

 

INDEMNITY FORM FOR RENTALS (BELTS AND BUCKLES PTY LTD) T/A ELECTREK

 

  1. I, hereby acknowledge that I am renting an electric bicycle/scooter from Electrek Cape Town (Hereinafter referred to as "belts and buckles pty ltd") and that I will be renting it entirely at my own risk. 

  2. I confirm that I am over the age of sixteen. 

  3. I confirm that I weigh less than 100kg’s.

  4. I confirm that I am not suffering from any medical condition that may preclude me from riding the electric bicycle/scooter. 

  5. I confirm that I am not under the influence of alcohol or any other intoxicating substances and I undertake not to ride the electric bicycle/scooter whilst under the influence of alcohol or any intoxicating substances.

  6. I understand that only one person at a time may ride the electric bicycle/scooter.

  7. I agree to lock up the electric bicycle/scooter when I am not riding it. 

  8. I confirm that I know how to ride a bicycle/e-scooter.

  9. I undertake to comply with the instructions of Cape Town Electrek’s employees and/or agents on how to ride an electric bicycle/scooter and confirm that I will only hire the electric bicycle/scooter if I am confident that I can ride same.

  10. I undertake to comply with the instructions of Cape Town Quarters employees and/or its agents.

  11. I confirm that I am aware of the procedure to be followed if the electric bicycle has a puncture whilst I am riding it. 

  12. I acknowledge that it is compulsory to wear the helmet provided by Cape Town Electrek on my head, whilst I am riding the electric bicycle/scooter

  13. I agree to adhere to the rules of the road when riding the electric bicycle/scooter

  14. I understand the inherent dangers and risks associated with bicycling and scootering and I assume and accept any and all responsibility for the medical risks associated with bicycling such as but not limited to, a heart attack or stroke, as well any and all responsibility for the risk of injury, paralysis or death, caused by any eventuality whatsoever arising, whilst I am utilising the electric bicycle/scooter.

  15. I waive my right to any and all claims arising from whatsoever cause or whatsoever nature, against Cape Town Electrek, its employees, agents and the City of Cape Town for any loss, injury, damage or harm which may be suffered or sustained arising out of or in connection with, my use of the electric bicycle/scooter, including any mechanical fault, and all other events related hereto, notwithstanding the fact that that such loss, injury, damage or harm may have been caused by the negligence of Cape Town Electrek, its employees or agents.

  16. I hereby indemnify, Cape Town Electrek, its employees or agents, against all or any claims which may be made against any of them by a third party (including my dependants) where such claim arises out of or in connection with my use of the electric bicycles and all other functions and events related hereto. 

  17. I accept that this contract sets out the full basis of the relationship between Cape Town Electrek and myself and acknowledge that it is governed by the laws of South Africa and in the event of my bringing legal action against Cape Town Electrek or its employees or agents, I agree that only the courts of South Africa shall have jurisdiction.     BELTS & BUCKLES PTY.LTD trading as Cape Town Electrek.

  18. I acknowledge that I will be responsible for all and any damage caused to the rental bicycle/scooter, including theft, from the time of delivery/acceptance thereof to the time of return thereof to Cape Town Electrek. 

  19. My liability for damage to the rental bicycle/scooter is absolute, whether or not the damage was caused by negligence, vicarious or otherwise. 

  20. I confirm that the rental bicycle/scooter is given to me in good order and condition and that I received an induction course on the use thereof. 

  21. Once the indemnity form has been signed, all bicycle/scooter rentals are non-transferable and non-refundable. 

  22. I hereby release, indemnify and hold harmless Electrek employees or agents from and against any claims, damages or liability arising from or related to the use of the images, recordings or material, including but not limited to claims of defamation, invasion of privacy, or rights of publicity or copyright infringement.

  23. By signing below, I confirm that I have read, understood and agree to the above-mentioned conditions and agree to this statement “I am giving up certain legal rights and/or remedies”. 

  24. I confirm that the information provided by me is true and correct.   

 

 

 

I consent to the collection recording, storing, and processing of my personal information contained in this indemnity, in terms of the Protection of Personal Information Act No. 4 2013 (POPIA)by Cape Town Electrek

Cape Town Electrek shall retain my personal information for as long as is necessary and in compliance with any legislation. 

I have the right to object to the collection recording processing and retention of my personal information, save or such information which must be retained by cape town Electrek in compliance with their statutory obligations. I have the right to request that my personal information be corrected or updated and lodge a complaint with the information Regulator.

INDEMNITY IN RESPECT OF MINOR CHILDRED (CHILDREN UNDER 18) d

 

 

I, ______________________________________________________________________ (full name and ID number of parent / legal guardian)

Being the parent / legal guardian of

___________________________________________________________________________(full name and ID number of child), hereby confirm that:     

 

  1. the minor child has my consent to hire and ride the electric bicycle/scooter and that should the electric bicycle/scooter be damaged (from whatsoever cause arising) or stolen that I will be held personally responsible for the costs of repairing or replacing same.

  2. I confirm that I have the authority to act on behalf of the minor child. 

  3. I confirm that the minor child will comply and be bound by all of the terms and conditions as set out above and I (or any third party acting on the minor child’s behalf) will in turn waive any and all claims, of whatsoever nature arising against Cape Town Electrek, its agents or employees, for any loss, injury, damage or harm to the minor child, whilst operating the electric bicycle/scooter.

  4. I agree to indemnify Cape Town Electrek, its employees or agents and hold all parties harmless for any claim of whatsoever nature and from whatsoever cause arising, which may be brought by any third party as a result of the minor child’s use or misuse of the electric bicycle. 

  5. By signing below,  I further confirm that I that have read, understood and agree to this statement “I am giving up certain legal rights and/or remedies on the minor child’s behalf.”.
